A just and efficient legal system respects what is called “the rule of law.”1 Scottish Presbyterian minister Samuel Rutherford coined this term2 for a concept first articulated by Aristotle.3 “Stripped of all technicalities,” Friedrich A. Hayek argued, the rule of law “means that government in all its actions is bound by rules fixed and announced beforehand—rules which make it possible to foresee with fair certainty how the authority will use its coercive powers in given circumstances . . . .”4
